Complete Terms & Conditions

Welcome to HireTheDevelopers ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website located at https://hirethedeveloper.com/ (the "Platform"), including all services, features, content, and functionality offered through the Platform. By accessing or using the Platform, registering an account, submitting a hiring request, or applying as a developer or partner, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

For the purposes of these Terms:

• "Client" refers to any business, startup, or individual who registers on the Platform to hire tech talent.
• "Developer / Talent" refers to any software developer, designer, DevOps engineer, or technical professional listed on or registered through the Platform.
• "Partner" refers to any individual or organization that participates in HireTheDevelopers' partner or referral program.
• "Services" refers to the talent matchmaking, hiring facilitation, onboarding support, contract management, payroll processing, and related services offered by HireTheDevelopers.
• "Engagement" refers to any working arrangement between a Client and a Developer facilitated through the Platform.

To use the Platform, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction.
• Have the legal authority to enter into binding contracts.
• Provide accurate, complete, and up-to-date registration information.
• Not be barred from using the Platform under applicable laws.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at [email protected] of any unauthorized use of your account.

Detailed pricing information is available on our Pricing page at https://hirethedeveloper.com/pricing/. By engaging our Services, you agree to the following:

• All fees are as quoted at the time of service engagement and are subject to change with prior notice.
• Payments are due as per the agreed billing schedule (monthly, project-based, or otherwise as stated in the engagement agreement).

• Late payments may result in suspension of services.
• All fees are exclusive of applicable taxes unless stated otherwise. Clients are responsible for any applicable taxes, duties, or levies in their jurisdiction.
• Refund or cancellation terms will be outlined in your individual engagement agreement.

The minimum engagement period for hiring a dedicated Developer through our Platform is one (1) month. Clients may engage Developers on a full-time, part-time, or contract basis as outlined in the applicable engagement model. Either party may terminate an engagement in accordance with the notice period specified in the individual service agreement. HireTheDevelopers reserves the right to replace a Develop

Both Clients and Developers acknowledge that they may have access to confidential information in the course of using the Platform or engaging in a project. Each party agrees to:

• Keep all confidential information strictly confidential.
• Not disclose confidential information to any third party without prior written consent.
• Use confidential information solely for the purposes of the Engagement.

These confidentiality obligations survive the termination of any Engagement or these Terms.

You agree not to use the Platform to:

• Provide false, misleading, or inaccurate information during registration or any application process.
• Bypass or attempt to bypass the Platform to engage a Developer or Client directly for the purpose of avoiding Platform fees ("circumvention").
• Harass, abuse, or harm other users of the Platform.
• Upload or transmit viruses, malware, or any other harmful code.
• Violate any applicable local, national, or international laws or regulations.
• Engage in any activity that disrupts or interferes with the Platform's operation.
• Scrape, harvest, or collect data from the Platform without authorization.

Violation of these prohibitions may result in immediate termination of your account and access to the Platform, and may subject you to legal liability.

Clients and Developers agree not to directly engage or contract with each other outside of the Platform for a period of twelve (12) months after initial introduction through HireTheDevelopers, without the prior written consent of HireTheDevelopers. Any attempt to circumvent this restriction will result in account termination and may result in a claim for damages equivalent to fees that would have been payable to HireTheDevelopers.

You agree to indemnify, defend, and hold harmless HireTheDevelopers, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your use or misuse of the Platform.
• Any Engagement entered into through the Platform.
• Your infringement of any third-party rights.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

The Platform may contain links to third-party websites or integrate with third-party tools (e.g., Slack, Jira, Trello). These links are provided for convenience only. HireTheDevelopers does not endorse and is not responsible for the content, policies, or practices of any third-party websites or services. You access third-party services at your own risk.

HireTheDevelopers reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or applicable laws. Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination (including but not limited to confidentiality, intellectual property, non-circumvention, and limitation of liability) shall continue to apply.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HireTheDevelopers is incorporated, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or your use of the Platform shall be first subject to good-faith negotiation. If unresolved within thirty (30) days, disputes shall be submitted to binding arbitration or resolved through the courts of the applicable jurisdiction.

We reserve the right to update or modify these Terms at any time. When we do, we will revise the Effective Date at the top of this page and, where appropriate, notify you via email or a prominent notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms.
